KidsZone Foliage Drawing Contest Official Rules

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. TERM: Contest begins at 12:01:01 AM (ET) on October 1, 2009, and ends at 11:59:59 PM (ET) on November 15, 2009 ("Promotion Period"). Entries become the property of Sponsor and will not be returned or acknowledged.

1. ELIGIBILITY: The 2008 Yankee Foliage Drawing Contest is open to persons who are, as of entry, 13 years of age or younger and legal residents and physically located within the fifty (50) United States and the District of Columbia as of October 1. Employees of Sponsor and its respective affiliates, parents, subsidiaries, and advertising and promotion agencies involved with this Contest, and the immediate family members and/or those living in the same household of each, are not eligible to participate. Entrants must have a parent's or legal guardian's permission to enter. Contest is void in Puerto Rico and where prohibited.

2. HOW TO ENTER: Submit your original drawing of a fall scene ("Entry"). There is one method of entry: By mail: Legibly hand-print your full name, street address, city, state, ZIP code (no P.O. boxes), daytime phone number, and birth date, with parent's or legal guardian's signature, on one sheet of paper and send, along with your drawing on a separate sheet of paper, to: "Yankee Foliage Drawing Contest," Yankee Magazine, 1121 Main St., Dublin, NH 03444. MAIL-IN ENTRIES MUST BE RECEIVED BY NOVEMBER 10, 2008. Limit: one Entry per person. If additional Entries are received, only the Entry received earliest will be accepted. All Entries become the exclusive property of Sponsor and will not be returned unless a self-addressed, stamped envelope is included with Entry. Sponsor not responsible for incomplete, misaddressed, or postage-due Entries. Sponsor is under no obligation to communicate with entrants about Entries. By submitting an Entry, each entrant represents that (1) Entry is entirely the original work of the entrant; (2) Entry cannot involve the outside assistance of another person or professional; (3) entrant has the unrestricted right to submit the Entry; (4) entrant acknowledges and is bound by these Official Rules.

3. CONTEST PRIZES: The potential Winners (and parents or legal guardians) may be required to execute the following: (1) an affidavit of eligibility and liability release; (2) warranty of ownership and license; (3) publicity release. Unless otherwise prohibited by law, the potential Winner must sign these documents no later than 15 days from the date of prize notification in order for Sponsor to award the prize. Noncompliance or return of prize notification as undeliverable may result in disqualification and, at Sponsor's discretion, selection of an alternative Winner.

One (1) Prize Winner will be selected. The Prize consists of: (1) publication of Winner's name and drawing on YankeeFoliage.com in KidsZone; (2) a tote bag filled with a Weather Watcher's 2009 Calendar, The Old Farmers' Almanac Calendar, an Almanac for Kids Nalgene bottle, a mini garden toolset, a Backyard Safari bug scope, a Coleman Firefly lantern, and The Old Farmer's Almanac for Kids. With its full-color design and easy-to-read format, The Old Farmer's Almanac for Kids is a playground for a young person's imagination and curiosity. Based on The Old Farmer's Almanac (beloved by readers young and old since 1792!), the kids' edition spotlights the subjects for which the Almanac is best known: astronomy, nature, farming, gardening, history, and, of course, the weather. The informative and amusing stories, featuring hundreds of wacky and fascinating facts, will appeal to kids of all ages.

Approximate Retail Value ("ARV") of the Prize is $70. All prize details are at Sponsor's sole discretion; no prize transfer, assignment, or substitution by Winner permitted. Sponsor reserves the right to substitute any prize, in which case a prize of comparable value, determined by Sponsor's reasonable discretion, will be awarded. Odds of winning depend on the number of eligible Entries received.

Prize will be delivered to the front door of the Winner's home. Prize will be awarded (assuming sufficient number of eligible Entries are received). Prize not redeemable for cash. Sponsor reserves the right to substitute a prize of equal or greater value. No other substitution or transfer of prize permitted. Sponsor responsible only for prize delivery; not responsible for prize utility, quality, or otherwise.

4. JUDGING/SELECTION OF GRAND PRIZE WINNER: One (1) Grand Prize Winner will be selected from all eligible Entries received by representatives from Yankee Magazine, whose decisions are final on all matters relating to Contest. Judging will be based on the following criteria: 1) originality; 2) technique; and 3) color selection.

5. WINNER NOTIFICATION: The Grand Prize potential Winner will be selected on or about November 10, 2008. Potential Winner will be contacted by phone and mail. Winner (and parent or legal guardian) will be required to sign an affidavit of eligibility and liability release and, where permitted, a publicity release. Prize may be awarded to an alternative Winner if affidavit/release(s) is not returned within seven (7) business days after mailing to Winner, if prize notification or prize is returned as undeliverable. Winner agrees to use of name, hometown, likeness, and/or prize information for promotional purposes in any medium without additional compensation to the extent permitted by law. Disqualification and the selection of an alternative Winner may result from any noncompliance with Official Rules ("Rules").

6. REQUIREMENTS/CLEARANCES: All Entry content must be the original work of the entrant, may not have been previously published, may not have won previous awards, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. By submitting an Entry, entrant warrants and represents that he/she consents to the submission and use of the Entry in the Contest, and to its posting on the Internet and in Yankee Magazine in connection with the Contest. Decisions of the Sponsor and Judges are final and binding. Sponsor reserves the right not to award all prizes in the event an insufficient number of eligible entries meeting the minimum judging criteria are received, as determined by Sponsor and Judges in their sole discretion.

7. RIGHT TO DISQUALIFY: The Sponsor reserves the right, in its sole and unfettered discretion, to disqualify and remove at any time during the Contest any Entry that potentially or actually infringes any third party's copyright(s). Sponsor reserves the right, in its sole and unfettered discretion, to disqualify and remove any Entry that it believes contains any sexually explicit, disparaging, libelous, or inappropriate content, is not suitable for publication, infringes the rights of any third party, or otherwise does not meet any other requirements in these Official Rules.

8. GENERAL RULES: The Contest is governed by and subject to the laws of the United States. All federal, state, and local laws and regulations apply. Void where prohibited by law. By acceptance of Prize, Winner gives the Sponsor the right to publish, use, adapt, edit, and/or modify the Winner's photograph in any way, in any and all media, and without consideration to Winner or other identifiable persons depicted in photograph, and Winner irrevocably assigns and transfers all rights, title, and interest in the submission to the Sponsor and, if required, will sign any documents necessary to transfer copyright. By entering Contest and/or accepting Prize, entrant grants permission to Sponsor and its agencies to use Winner's name and/or likeness for purposes of advertising, publicity, and promotion, without further compensation to entrant unless prohibited by law.

9. LIMITATION OF LIABILITY: By accepting Prize, Winner (and his/her parent or legal guardian) agrees to hold Sponsor, its respective directors, officers, employees, and assigns, harmless against any and all claims and liability arising out of use of prize. Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this promotion or use/redemption of prize. Entrants agree to be bound by the Official Rules and the decisions of the judges, which are final and binding on all matters relating to this Contest. Sponsor not responsible for any typographical or other error in the printing of the offer, administration of the contest, or the announcement of the Prize. Sponsor is not responsible for any mailing errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft, destruction, unauthorized access to, or alterations of entry materials.

10. WINNING ARTIST: Visit YankeeFoliage.com to view the First Place Yankee Magazine Foliage Drawing, which will be posted after selection of Winner and will include the Winner's first name and state of residence.

12. CONFIDENTIALITY: By entering you may be contacted by the Sponsor with future promotional offers and will be enrolled in future contests, games, and sweepstakes the Sponsor may conduct unless you specifically ask not to be enrolled. Information provided by you to participate in this Contest is subject to Sponsor's privacy policy.
